If you choose Mediation, the Rs. 2,500/- consultation fee is adjusted against your registration fee. 1. Invitation: Sama contacts the other party (via call, email, SMS, WhatsApp, and Speed post) to seek consent. {Kindly note: Call, SMS and WhatsApp will only be possible with a registered Indian Mobile number; speed post will only be possible with a registered Indian address.} 2. Consent: Mediation proceeds only if the other party agrees. If they decline/do not respond within a duration of 15 days, no further fees apply beyond the initial registration. 3. Fee Structure: Once both parties agree to participate, the following fair and transparent pricing applies:
Understanding the Fees:
Registration Fee - Applicable to all cases referred to Sama. (Not applicable to parties who have completed consultation. Kindly note: If a party has more than one dispute and consultation has been conducted, Registration fee for one case will be exempted but will be due and payable for all additional cases.)
Consent Fee - Applicable only to cases where both parties agree to participate. In addition to the registration fee. (Consent fee will be payable prior to the Mediation session being conducted and scheduled.)
Settlement Fee - Applicable only to disputes which settle and have a signed conciliation award or parties resolve with each other without documentation. In addition to the registration and consent fee. The final binding settlement award will be shared with the parties subsequent to the Settlement fee being paid. In the event, the settlement fee is not paid by either of the party, no further matters will be entertained on the Sama platform.
GST will be added at the time of invoicing.
For disputes without a defined claim amount, fees range from Rs 10,000/- to Rs 1,00,000/- per session (up to 3 hours), based on the subject matter of the dispute, mediator’s profile and complexity of the matter.

Arbitration is suitable for disputes where the parties have agreed in writing to resolve their disputes through arbitration (i.e., there is a valid arbitration agreement or dispute resolution clause in the contract). The agreement containing the arbitration clause has to be signed by all the parties to the agreement. This would be the pre-requisite for an arbitration proceeding to be initiated by either party. It is best suited for cases requiring a final and binding determination, particularly those involving defined monetary claims or contractual rights, such as: • Loan recovery & banking disputes • Commercial & contractual disputes • Partnership & employment disputes • Property-related monetary claims If there is no arbitration clause in the agreement, arbitration can proceed only if both parties mutually agree to submit the dispute to arbitration after it arises. Thereafter, Sama will only be able to provide the administrative support to conduct such arbitrations, if both the parties consent to the same. Note: Criminal offences and certain non-arbitrable matters under applicable law cannot be resolved through arbitration.

• Payment of Stamp Duty: An arbitration award will be a Stamped Award. Basis the seat of the arbitration, the Stamp duty will be computed at the outset of the dispute( As per the respective State’s Stamp Act) and will have to be paid over and above the Fee structure mentioned above. Should either party or both parties not require a stamped award, the same can be communicated at the time of initiation. In any scenario, where the stamp duty collected is higher or the proceedings get withdrawn prematurely without a final award, the same will be refunded by Sama after the closure of the dispute. Where stamp duty computed and collected is lower than the actual stamp duty, final award will be passed after realisation of the difference in stamp duty. There is also an additional stamp procurement charge of INR 40/- +GST per stamp.
• Physical Couriers and Communication: During the Online arbitration journey, Sama will be sending all communications out through SMS, Email and WhatsApp. Sama, sends two notices (Invocation of arbitration notice and The Final Award) to one address each through Speed Post as well. These communications are blended with the cost mentioned above. Should there be a requirement of sending additional notices physically beyond the two notices mentioned, it would attract a fee of INR 100/- + GST per notice per address.
• Execution Packet: Subsequent to the completion of the Arbitration Proceedings, should either party request for an Execution packet containing all the orders, award, documents, evidences and tracking of notices transpired in the arbitration proceedings, the same will be provided by Sama at an additional Cost of INR 500/- + GST.

Who can become a Mediator?
A mediator is an independent neutral professional empaneled with Sama who facilitates discussions between disputing parties to help them reach a mutually acceptable settlement. The mediator does not impose a decision.
Roles and Responsibilities:
• Facilitate communication between parties in a neutral manner.
• Conduct mediation sessions through Sama’s online dispute resolution platform.
• Help identify issues and guide parties toward settlement options.
• Assist in drafting the settlement agreement if the parties reach consensus.
• Maintain confidentiality, neutrality, and procedural fairness.
Qualifications:
• Minimum 4 years of professional experience.
• Background in law, finance, banking, accounting, management, or related fields.
• Good negotiation, communication, and dispute resolution skills.
• Ability to conduct proceedings digitally.
Onboarding Process:
1. Registering and completing the Sama ODR course available on the website (Available here: https://courses.sama.live/course/certificate-course-in-online-dispute-resolution?previouspage=home&isenrolled=no#/home)
2. Once the course is completed, there is an interview with a Behavioural Psychologist, basis the feedback of the Psychologist and verification of the educational and professional qualification a neutral verification is complete.

If you choose Mediation, the Rs. 2,500/- consultation fee is adjusted against your registration fee. 1. Invitation: Sama contacts the other party (via call, email, SMS, WhatsApp, and Speed post) to seek consent. {Kindly note: Call, SMS and WhatsApp will only be possible with a registered Indian Mobile number; speed post will only be possible with a registered Indian address.} 2. Consent: Mediation proceeds only if the other party agrees. If they decline/do not respond within a duration of 15 days, no further fees apply beyond the initial registration. 3. Fee Structure: Once both parties agree to participate, the following fair and transparent pricing applies:
Understanding the Fees:
Registration Fee - Applicable to all cases referred to Sama. (Not applicable to parties who have completed consultation. Kindly note: If a party has more than one dispute and consultation has been conducted, Registration fee for one case will be exempted but will be due and payable for all additional cases.)
Consent Fee - Applicable only to cases where both parties agree to participate. In addition to the registration fee. (Consent fee will be payable prior to the Mediation session being conducted and scheduled.)
Settlement Fee - Applicable only to disputes which settle and have a signed conciliation award or parties resolve with each other without documentation. In addition to the registration and consent fee. The final binding settlement award will be shared with the parties subsequent to the Settlement fee being paid. In the event, the settlement fee is not paid by either of the party, no further matters will be entertained on the Sama platform.
GST will be added at the time of invoicing.
For disputes without a defined claim amount, fees range from Rs 10,000/- to Rs 1,00,000/- per session (up to 3 hours), based on the subject matter of the dispute, mediator’s profile and complexity of the matter.

• Legally Binding: The award is enforceable, equivalent to a civil court decree. • Speed: Much faster than traditional litigation. Arbitration will conclude at Sama within a duration of 180 days. • Convenience: Platform access for tracking updates and progress, fully digital filings and virtual hearings. Data and document repository will be available for a duration of 3 years. • Continuity: Proceedings can continue even if one party fails to participate (subject to law).

Arbitration is suitable for disputes where the parties have agreed in writing to resolve their disputes through arbitration (i.e., there is a valid arbitration agreement or dispute resolution clause in the contract). The agreement containing the arbitration clause has to be signed by all the parties to the agreement. This would be the pre-requisite for an arbitration proceeding to be initiated by either party. It is best suited for cases requiring a final and binding determination, particularly those involving defined monetary claims or contractual rights, such as: • Loan recovery & banking disputes • Commercial & contractual disputes • Partnership & employment disputes • Property-related monetary claims If there is no arbitration clause in the agreement, arbitration can proceed only if both parties mutually agree to submit the dispute to arbitration after it arises. Thereafter, Sama will only be able to provide the administrative support to conduct such arbitrations, if both the parties consent to the same. Note: Criminal offences and certain non-arbitrable matters under applicable law cannot be resolved through arbitration.

• Payment of Stamp Duty: An arbitration award will be a Stamped Award. Basis the seat of the arbitration, the Stamp duty will be computed at the outset of the dispute( As per the respective State’s Stamp Act) and will have to be paid over and above the Fee structure mentioned above. Should either party or both parties not require a stamped award, the same can be communicated at the time of initiation. In any scenario, where the stamp duty collected is higher or the proceedings get withdrawn prematurely without a final award, the same will be refunded by Sama after the closure of the dispute. Where stamp duty computed and collected is lower than the actual stamp duty, final award will be passed after realisation of the difference in stamp duty. There is also an additional stamp procurement charge of INR 40/- +GST per stamp.
• Physical Couriers and Communication: During the Online arbitration journey, Sama will be sending all communications out through SMS, Email and WhatsApp. Sama, sends two notices (Invocation of arbitration notice and The Final Award) to one address each through Speed Post as well. These communications are blended with the cost mentioned above. Should there be a requirement of sending additional notices physically beyond the two notices mentioned, it would attract a fee of INR 100/- + GST per notice per address.
• Execution Packet: Subsequent to the completion of the Arbitration Proceedings, should either party request for an Execution packet containing all the orders, award, documents, evidences and tracking of notices transpired in the arbitration proceedings, the same will be provided by Sama at an additional Cost of INR 500/- + GST.

Who can become a Mediator?
A mediator is an independent neutral professional empaneled with Sama who facilitates discussions between disputing parties to help them reach a mutually acceptable settlement. The mediator does not impose a decision.
Roles and Responsibilities:
• Facilitate communication between parties in a neutral manner.
• Conduct mediation sessions through Sama’s online dispute resolution platform.
• Help identify issues and guide parties toward settlement options.
• Assist in drafting the settlement agreement if the parties reach consensus.
• Maintain confidentiality, neutrality, and procedural fairness.
Qualifications:
• Minimum 4 years of professional experience.
• Background in law, finance, banking, accounting, management, or related fields.
• Good negotiation, communication, and dispute resolution skills.
• Ability to conduct proceedings digitally.
